1. Acceptance of Terms
By accessing or using EventsVibe (the Platform), including the website at eventsvibe.com, our mobile applications, and any related services, you (the User) agree to be bound by these Terms of Service (Terms) and our Privacy Policy.
If you do not agree with any part of these Terms, you must not use the Platform. Continued use after any update constitutes acceptance of the revised Terms.
⚠️ These Terms include a binding arbitration clause and a class-action waiver that affect your legal rights. See Section 16.

2. Definitions
- Platform — the EventsVibe website, applications, and related services operated by EventsVibe Technologies Pvt. Ltd.
- Attendee — a User who purchases or attempts to purchase tickets through the Platform.
- Organizer — a User who creates, lists, or manages events on the Platform.
- Event — any concert, conference, workshop, festival, screening, or gathering listed on the Platform.
- Ticket — a digital pass entitling its holder to admission to a specified Event, subject to its terms.
- Content — any text, images, video, audio, or other material posted on or through the Platform.

3. Eligibility & Account Registration
You must be at least 18 years old (or the legal age of majority in your jurisdiction, whichever is higher) to create an account or purchase tickets. By registering you represent that:
- The information you provide is accurate, current, and complete.
- You will keep your information up to date.
- You are not barred from using the Platform under applicable law.
- You will use the Platform only for lawful purposes and in accordance with these Terms.
Each individual is permitted only one personal account. We may verify your identity at any time and refuse, suspend, or terminate accounts that violate these Terms.

4. Account Security
You are responsible for safeguarding your password and for any activity under your account. You agree to:
- Use a strong, unique password and enable two-factor authentication when offered.
- Notify us immediately at security@eventsvibe.com of any unauthorized access.
- Not share your account credentials with anyone.
ℹ️ EventsVibe will never ask for your password by email, SMS, or phone. Treat any such request as a phishing attempt and report it to us.

5. Ticket Purchases
When you purchase a Ticket through the Platform:
- You enter into a transaction with the Organizer of the Event; EventsVibe acts solely as the technology and payment intermediary.
- Tickets are delivered electronically to your registered email and are also accessible from your account dashboard.
- Each Ticket carries a unique QR code. Reproducing, transferring, or duplicating Tickets is prohibited and may invalidate your entry.
- Ticket inventory is limited and is allocated on a first-come, first-served basis. Adding a Ticket to your cart does not reserve it.
- Final price, taxes (GST), and platform/payment fees are shown at checkout. By completing payment you accept these charges.
ℹ️ Once issued, Tickets cannot be re-allocated to a different Attendee unless the Organizer expressly enables ticket transfer for that Event.

6. Refunds, Cancellations & Rescheduling
Refund eligibility is set by each Organizer and disclosed on the Event page before purchase. EventsVibe enforces the following baseline rules:
- Event cancelled by Organizer: full refund of the Ticket face value within 10 business days. Platform and payment-gateway fees are refunded as well.
- Event rescheduled: Tickets remain valid for the new date. If you cannot attend, you may request a refund within 7 days of the rescheduling notice.
- Attendee-initiated refunds: Subject to the Organizer's posted policy. Where the Organizer permits a refund, processing fees may be deducted.
- Force majeure: Events cancelled due to natural disasters, government orders, or other unforeseeable causes will be refunded at face value at the Organizer's discretion.
Approved refunds are credited to the original payment method within 5–10 business days. To request a refund, visit your dashboard or email support@eventsvibe.com.

7. Event Organizer Obligations
If you list Events as an Organizer, you represent and warrant that:
- All Event details (dates, venue, lineup, capacity, age restrictions) are accurate and current.
- You hold all necessary licenses, permits, performance rights, and insurance for the Event.
- You will fulfill every Ticket sold and admit holders in accordance with the published terms.
- You will respond to Attendee queries within 48 hours.
- You will not discriminate against Attendees on grounds prohibited by law.
- You will comply with all tax obligations, including GST collection and remittance where applicable.
EventsVibe disburses Ticket proceeds to Organizers per the schedule defined in the Organizer Agreement, typically T+5 business days after the Event concludes.

8. Platform Fees & Pricing
EventsVibe charges the following fees:

All fees are exclusive of applicable taxes. EventsVibe reserves the right to change fee structures with 30 days' prior notice; existing listings honour the rate in effect at the time of listing.

9. Prohibited Conduct
You agree not to:
- Resell tickets at inflated prices or use bots, scripts, or any automated means to acquire Tickets in excess of stated limits.
- Create or list fraudulent, misleading, or non-existent events.
- Impersonate any person or entity, or misrepresent your affiliation with one.
- Upload viruses, malware, or otherwise interfere with the Platform's operation or security.
- Scrape, mirror, or reverse-engineer any portion of the Platform.
- Use the Platform to send unsolicited communications (spam) or for any unlawful purpose.
- Harass, threaten, or defame other Users, Organizers, or our staff.
- Circumvent fees, payment systems, or any technical measure designed to protect the Platform.
⚠️ Violations may result in immediate account suspension, ticket invalidation, forfeiture of pending payouts, and legal action.

10. Intellectual Property
The Platform — including its software, design, logos, trademarks, and editorial content — is owned by EventsVibe Technologies Pvt. Ltd. and protected by Indian and international intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Platform solely for its intended purpose.
Event imagery, descriptions, and artist content are owned by the respective Organizers or licensed to them. You may not copy, modify, distribute, or create derivative works from any Platform content without prior written consent.

11. User-Generated Content
When you post reviews, comments, photos, or other Content, you grant EventsVibe a worldwide, royalty-free, non-exclusive license to host, display, reproduce, and distribute that Content in connection with operating and promoting the Platform. You retain ownership of your Content.
You represent that your Content:
- Does not infringe any third party's rights (including IP, privacy, or publicity rights).
- Is not defamatory, obscene, hateful, or otherwise unlawful.
- Does not contain personal information about others without their consent.
We may, but are not obligated to, moderate Content and may remove anything we believe violates these Terms or our community guidelines.

12. Privacy
Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the Platform you consent to the data practices described there.

13. Disclaimers & Limitation of Liability
The Platform is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, or non-infringement.
EventsVibe does not warrant that any Event will take place, will meet your expectations, or will be free from injury or loss. We are not responsible for the conduct of Organizers, Attendees, performers, venues, or third parties.
To the maximum extent permitted by law, EventsVibe's total aggregate liability arising out of or in connection with your use of the Platform is limited to the greater of (a) the total fees paid by you to EventsVibe in the twelve (12) months preceding the claim, or (b) ₹5,000.
In no event shall EventsVibe be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits or lost data, even if advised of the possibility.

14. Indemnification
You agree to indemnify, defend, and hold harmless EventsVibe, its affiliates, officers, directors, employees, and agents from any claims, damages, liabilities, costs, and expenses (including reasonable attorney's fees) arising out of:
- Your breach of these Terms or any applicable law.
- Your Content or your use of the Platform.
- Your interactions or transactions with other Users, including Organizers and Attendees.

15. Suspension & Termination
You may close your account at any time from your dashboard or by contacting support. EventsVibe may suspend or terminate your access — with or without notice — if we believe you have violated these Terms, created risk for the Platform or other Users, or failed to pay amounts owed.
Upon termination, your right to use the Platform ceases immediately. Sections that by their nature should survive termination — including IP, indemnification, disclaimers, limitation of liability, and dispute resolution — will continue in effect.

16. Governing Law & Dispute Resolution
These Terms are governed by the laws of India without regard to conflict-of-laws principles.
Any dispute arising out of or relating to these Terms or the Platform shall first be addressed through good-faith negotiation. If unresolved within 30 days, the dispute shall be referred to binding arbitration under the Arbitration and Conciliation Act, 1996, before a sole arbitrator appointed by EventsVibe. The seat of arbitration shall be Mumbai, India, and proceedings shall be conducted in English.
Class-action waiver: You agree to bring claims only in your individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.

17. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated via email to the address registered to your account or via a prominent notice on the Platform at least 14 days before they take effect. The "Last updated" date at the top of this page reflects the latest revision.
Your continued use of the Platform after the effective date of any change constitutes acceptance of the revised Terms. If you do not agree, you must discontinue use.
